PRIVACY POLICY

1. What this Privacy Policy covers:

The ZoomRx Site, ZoomRx Apps & web browser extension Perxcept (collectively referred to as The Service) are the online & mobile medical panel & data collection service of ZoomRx Inc.

The Service enables respondents to

(i) complete surveys to provide feedback and opinions on a range of healthcare and medical topics

(ii) install and provide consent to track ‘Behavior data’. Active respondents receive certain benefits from the Service in exchange for participating in market research.

We, at ZoomRx, respect the privacy of every respondent. We take every reasonable step to ensure that our respondents’ information is secure with us.

2. WHAT INFORMATION IS COLLECTED:

As a ZoomRx respondent you will share two kinds of information with us:

Administrative Information:

(I) This is information you provide to us one-time that we will enable us to administer surveys to you, identify surveys that you qualify for, process your honoraria and perform other administrative tasks associated with surveys.

(II) Administrative Information includes but is not limited to one or more of the following: Name, Address, Phone Number, Fax Number, Email Address, NPI Number, Specialty, Sub-specialty, Profession, Age, PayPal Account ID.

(II) We do not collect credit card information. However, to download the ZoomRx application from the Apple App Store or Google Play Store, you might need to provide this information to Apple or Google respectively.

Survey Information & Behavior data:

1. Survey information is what you provide by participating in a ZoomRx survey. Usually, you will receive honoraria payments from ZoomRx for providing Survey Information.

2. Some studies request additional information such as your behaviors, preferences and online content you are exposed to, in order to help us better understand consumer behavior, use, and trends. "Behavior data" means when, why or how you do things, such as how frequently you surf the internet, what websites you visit, or what content you view on specific websites.

Depending on your level of participation, our software comprehensively tracks activity on panelists computers and/or devices, whether offline or online. Data collected from your computer or device may include:

(I) Website activity, such as the URLs (addresses) of websites you visit

(II) Information about your device, applications, system, network, and hardware, including your Internet Protocol (IP) address, the Internet Service Provider being used, the type of browser you are using, device identifier, device model, operating system, and language set

(III) The content of the specific websites you visit from a list of websites that you allow us to track

(IV) Ads that you view across websites, including but not limited to other healthcare related websites that are not part of or agreed to in the predefined list. The website content and the URLs other than the ads you see will NOT be captured

(V) Specific emails and other website content that you choose to share with us directly through the Perxcept platform

Our web browser extension tracks your online activity on your computer and encrypts this information to help ensure its security before it sends the information to us automatically over the Internet. We cannot examine or modify any emails or content that are not covered as part of the “behavioral data'' that Perxcept collects, we cannot examine or use the text of any emails, and we cannot read the content of any document open on your computer. We also do not collect sensitive information.

Participation in ZoomRx services is completely voluntary.

3. HOW INFORMATION IS USED:

Administrative Information:

(I) We use Administrative Information solely for the conduct of our Market Research business.

(II) Administrative Information could be used to determine your eligibility to participate in surveys, to recruit you to participate in surveys, to communicate with you regarding surveys, to administer honoraria after your participation in surveys and to facilitate any other administrative tasks related directly or indirectly to your participation is surveys.

(III) Administrative Information may be combined with information collected about you by us or third parties with your express permission, with information that is collected about you from public records, or with information that we may acquire from third parties that have a legal right to provide such information to us.

Survey Information & Behavior data:

We use Survey Information and behavior data solely in the conduct of our Market Research business. As is the case with Administrative Information, Survey Information and behavior data may be combined with information collected about you by third parties with your express permission, with information that is collected about you from public records, or with information that we may acquire from third parties that have a legal right to provide such information to us.

4. HOW THE INFORMATION IS SHARED:

Administrative Information:

(I) Administrative Information will not be shared with any third party without your express permission, except that we may disclose your information if we believe we are required to do so by law, if we need to do so to protect someone's safety or our rights or property, or in order to comply with this policy or other policies that may be applicable.

(II) In addition, occasionally we will share contact information, such as name and address, with third parties with whom we have partnered to provide specific services to us, or services on behalf of us, such as but not limited to panel recruitment or honoraria processing. These partners have agreed not to share or resell this data and they are contractually obligated not to use any personally identifiable information except for the purpose of providing these services, unless you enter into a relationship with them that would directly allow them to do so.

(III) Our research clients will not receive Administrative Information in a manner that will enable them to identify individual respondents. To the extent that any Administrative Information is shared with our research clients, it will be in an anonymized and aggregated format.

Survey Information & Behavior data:

(I) We share Survey Information and behavior data with our research clients in an anonymous form.

(II) In your Survey Information, if you report an adverse reaction to a particular pharmaceutical product and the manufacturer of that product has commissioned the project, we are obligated to report details of the finding back to the manufacturer of the pharmaceutical. This is to make sure that the reporting of these incidents, as required by the FDA, is as accurate as possible and that the manufacturers are able to provide the best possible health care products. However, this will still be reported anonymously.

5. ACCESS TO INFORMATION:

Administrative Information:

You are in control of the Personally Identifiable Information that you provide us. You can:

(I) Ask for a copy of your Administrative Information.

(II) Ask for your Administrative Information to be corrected or updated.

(III) Ask us to remove your Administrative Information from your records.

To review and edit Administrative Information, you can visit the ‘Profile’ section of the ZoomRx Apps or ZoomRx Site.

Survey Information & Behavior data:

The information collected by the survey differs for each survey. To review and/or edit any Survey Information after it has been submitted, please email [email protected] or [email protected]

6. DATA SECURITY & INTEGRITY:

We implement commercially reasonable security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We restrict access to data collected to individuals who may need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. Any personal information submitted by you will be dealt with in accordance with our terms and conditions set forth herein and with any legislation or best practice regarding adverse event reporting.

To enhance the protection of information sent to or from the Service over the Internet, we implement the following security features.

(I) HTTPS - We require that a "secure session" be established through the use of Hypertext Transfer Protocol Secure (HTTPS), which is a combination of the Hypertext Transfer Protocol (HTTP) and the Transport Layer Security (TLS)/Secure Sockets Layer (SSL) protocol. This is done any time you supply or access information in one of our secure online areas. HTTPS creates a private conversation that only your computer and the Service’s systems can understand. HTTPS encodes information as it is being sent over the Internet between your computer and the Service’s systems helping to ensure that the transmitted information remains confidential.

(II) User ID and Password - The use of a user ID and password is an additional security measure that helps protect your information. This allows us to verify who you are, thereby allowing you access to your account information and preventing unauthorized access.

(III) ZoomRx Website: When you have finished using a secure area of our website, always click on the "Log Out" link which appears on every secure page. When you click on the "Log Out" link, your secure session will be terminated. No further secure transactions can be conducted without re-entering your user ID and password. You should be aware that browser software often "caches" a page as you look at it, meaning that some pages are saved in your computer's temporary memory. Therefore, you may find that clicking on your "Back" button shows you a saved version of a previously viewed page. Caching in no way affects the security of your confidential user ID or password.

(IV) ZoomRx Apps: When you have finished using the ZoomRx App, you can log out by clicking on the “Log Out” button which can be accessed from the App Menu.

7. DATA TRANSFERS:
Your Administrative Information, Survey Information & Behavior data will generally be stored in our databases, which are located in the United States. For easier processing of e-mail communications, recruitment, analysis, or other administrative purposes, however, your Administrative Information , Survey Information Behavior data may be sent to countries outside the United States or the European Union. Our data protection standards are the same, regardless of where your information is stored.
8. Opt Out:
You may "opt out" of receiving marketing or promotional emails from us by following the instructions in those emails. If you opt out of these messages, you will still receive emails from us, about your account, your honoraria, our services and other pertinent information related to the Service. These communications are considered part of the service and your account, which you cannot opt-out from receiving without terminating your account.
9. TERMINATION:
At any time, you may discontinue your use of the Service by sending us an email ([email protected] or [email protected]). Please note that opting-out of the Service will not automatically cause us to delete your Administrative Information that we have previously collected. We will do so, however, at your request, as set forth above.
10. RIGHT TO TRANSFER:
In the event that the Company and/or the Service is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditor's rights generally, we may not be able to control how your personal information is treated, transferred, or used.
11. CHANGES AND UPDATES TO THIS PRIVACY POLICY:
This Privacy Policy may be revised periodically and this will be reflected by the "effective date" above. Please revisit this page to stay aware of any changes. Your continued use of the Service constitutes your agreement to this Privacy Policy and any amendments.
